Health Technology Assessment in the UK and Germany

In 1999, the UK set up the National Institute for Clinical Excellence (NICE), now renamed the National Institute for Health and Clinical Excellence. Germany followed suit in 2004 with the Institute for Quality and Efficiency in Health Care (IQWiG). Both institutions pursue different strategies with different outcomes. This paper analyses the performance of these institutions in terms of relevance, strategy, responsibility, transparency and stakeholder involvement, all in the wider context of the strengths and weaknesses of HTA as a form of healthcare rationing tool. Free Use or Fair Use?

Today the internet – and companies operating as internet mediators – finds itself at the centre of a contemporary legal and philosophical conflict over the protection of intellectual property rights. The Viacom v YouTube case is only the latest in a long list of court cases. This report seeks to analyse the current legal and philosophical disputes between internet mediators and content creators with regards to the protection of intellectual property on the internet, and to put this dispute within a wider context and debate over the protection of intellectual property.

The Endogenous Entry Approach to Antitrust

In this paper, Professor Etro investigates recent research into industrial organization and proposes a new approach to antitrust issues. Focusing on the extent to which conditions within a market determine the entry of firms into it, the paper finds that technological constraints and demand conditions can change the way we understand market leader behaviour such as mergers, cartelisation, and other actions which affect the legal conception of antitrust. Accordingly, Etro finds that entry conditions should play a significant role in any antitrust investigation, and that, when entry into a market can be regarded as endogenous, spontaneous market forces can guarantee efficiency better than generous policy intervention.
